Your privacy is important to us. Buildsoft has created this privacy policy with everything you need to know about how we collect, use, share and store personal identifiable information from and about you. This information must be provided if you wish to use the Sites, and any Products and/or Services belonging to Buildsoft (“Products and/or Services”).
This policy applies to all websites owned or operated by Buildsoft (such as www.buildsoft.com.au, www.cubitselect.com, www.cubitsoftware.com and au.mybartender.co, the “Sites”, and any related websites, sub-domains and pages), as well as any hosted services operated by Buildsoft (such as Cubit Select) (“Hosted Services”).

Through your use of the Sites, Products and/or Services, Hosted Services, Buildsoft may also collect information from you about someone else. If you provide Hosted Services with personal information about someone else, you must ensure that you are authorised to disclose that information to Buildsoft and that, without Hosted Services taking any further steps required by applicable data protection or privacy laws, Hosted Services may collect, use and disclose such information for the purposes described in this policy.
This means that you must take reasonable steps to ensure the individual concerned is aware of and/or consents to the various matters detailed in this policy, including the fact that their personal information is being collected, the purposes for which that information is being collected, the intended recipients of that information, the individual's right to obtain access to that information, Buildsoft’s identity, and how to contact Buildsoft.
Where requested to do so by Buildsoft, you must also assist Buildsoft with any requests by the individual to access or update the personal information you have collected from them and entered into the Sites, Hosted Services or in connection with any Products and/or Services.

We work with third party service providers to provide website, application development, hosting, maintenance, back-up, storage, virtual infrastructure, payment processing, analysis and other services for us. These service providers may have access to or process your information for the purpose of providing those services for or on behalf of Buildsoft. Except for the parties described above, we do not sell or share the information with third parties without your consent.
Some of Buildsoft’s website pages utilise white-labeling techniques to serve content from our service providers while providing the look and feel of our Sites.
Buildsoft reserves the right to transfer any information to our successors in business and purchasers of Sites, Products and/or Services assets or a particular division or line of business. We also reserve the right to access and/or disclose any information as required by courts or administrative agencies and to the extent necessary to permit us to investigate suspected fraud, harassment or other violations of any law, rule or regulation, the Sites rules or policies, or the rights of third parties or to investigate any suspected conduct which Buildsoft deems improper.
6. How we store and secure the information
We use top tier, third party data hosting providers’ to host our Sites and Hosted Services on servers located in Australia. If you are a non- Australian resident, this means that your personal information will be transferred to Australia.
By entering personal information into the Sites and Hosted Services, you consent to that personal information being hosted on servers located in Australia. While your personal information will be stored on servers located in Australia it will remain within Buildsoft’s effective control at all times. Each data hosting provider’s role is limited to providing a hosting and storage service to Buildsoft, and we’ve taken steps to ensure that our data hosting providers do not have access to, and use the necessary level of protection for, your personal information. They do not control, and are not permitted to access or use your personal information, except for the limited purpose of storing the information. This means that, for the purposes of Australian privacy legislation and Australian users, Buildsoft does not currently “disclose” personal information to third parties located overseas.
If you do not want your personal information to be transferred to a server located in Australia, you should not provide Buildsoft with your personal information or use the Sites, Products and/or Services.

We may change this policy from time to time. If we make any changes, we will notify you by revising the ‘last updated’ date in the Effective Date section at the top of this policy. We encourage you to review our policy whenever you use Buildsoft’s Sites, Products and/or Services to stay informed about our information practices and the ways you can help protect your privacy.
If you do not agree with this policy or any changes to this policy, you will need to consider not using Buildsoft’s Sites, Products and/or Services. This should only be done in discussion with Buildsoft, to ensure you are aware of any effects or impacts that may result from discontinuing use of Buildsoft’s Sites, Products and/or Services and any further obligations under any existing contracts.
Buildsoft may also automatically collect (through cookies, described below, and other methods) and store aggregate or anonymous information about user contact with and use of the Sites, Products and/or Services. Examples of this type of information include demographic information, the type of internet browser you are using, the type of computer operating system application software and peripherals you are using, the domain name of the website from which you linked to our Sites and your browsing habits on and usage of the Sites. Non-personally identifiable information may also include personally identifiable information that has been aggregated so that no one individual is specifically identifiable (such as, how many users in a particular city access the Sites).
We may share non-personally identifiable information with third parties for any number of reasons, including advertising, promotional and/or other purposes.

We also obtain information from third parties and combine that with information we collect through Buildsoft’s Sites, Products and/or Services. For example, we may have access to certain information from a third party social media or authentication service or support service if you log into Buildsoft’s Sites, Products and/or Services through the service or otherwise provide us with access to Information from the service. Any access that we may have to such information from a third party social or authentication service is in accordance with the authorisation procedures determined by that service. By authorising us to connect with a third party service, you authorise us to access and store your name, email address(es), current city, profile picture URL, and other information that the third party service makes available to us, and to use and disclose it in accordance with this policy, and in accordance with applicable privacy laws. You should check your privacy settings on these third party services to understand and change the information sent to us through these services.

We may use cookies and similar technologies to collect non-personally identifiable information from you and to customise your use of the Sites. A cookie is a small data file that certain websites write to your hard drive when you visit them. We may also use web bugs, clear gifs and similar technologies that collect data similar to that collected by a cookie. A cookie file can contain various types of information, including a user ID that the site uses to track the pages you have visited.
Most browsers are initially set up to accept cookies; however, you can reset your browser to refuse all cookies or indicate when a cookie is being sent or you can flush your browser of cookies from time to time. If you choose to disable cookies or refuse to accept a cookie, you may not be able to utilise all features of the Sites.

The Sites may contain links to websites maintained by third parties. Buildsoft is not responsible for the privacy practices of such third party sites. You should carefully read their own privacy policies before providing any information to such third parties.
13. Opt Out Procedures
You have the option to opt out of receiving information from Buildsoft. This opt out messaging will appear at the bottom of every promotional email that is sent out to you by Buildsoft in relation to the Sites. Buildsoft also gives you the option to remove your information from its database of active users. If you no longer wish to take advantage of the Sites or to receive any form of direct contact from Buildsoft, whether it is email, discounts, newsletters, or other promotional offers or materials, or wish us to delete your personally identifiable information from our database of active users, or do not wish to be publicly acknowledged as a customer, send us a request marked "Privacy — Urgent", addressed as follows: privacy@buildsoft.com.au.
However, Buildsoft is not responsible for removing information from third party lists, databases or social networks of any kind if we have shared your information with such third parties as permitted by this policy.
Please note that, notwithstanding the fact that we may have removed your information from our list of active users, we reserve the right to keep any information submitted or collected for business reasons, such as archiving data.
In order to ensure that the information we maintain is accurate, Buildsoft gives users the option to change or modify their information previously provided. If you would like to change your information currently in our database, please contact us at privacy@buildsoft.com.au. Buildsoft is not responsible for updating information contained in third party lists, databases or social networks.
We are committed to taking reasonable steps to ensure the security of your information. To prevent unauthorised access, maintain data accuracy, and ensure the appropriate use of information, we have put into place physical, electronic, and managerial procedures to help safeguard and secure the information we collect. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and us or information stored on the Sites or our servers, will be completely free from unauthorised access by third parties such as hackers and your use of the Sites demonstrates your assumption of this risk.
Any website pages that require the submission of credit card data will employ SSL security.
To the extent permitted by law, we may retain or archive information indefinitely to provide continued use of our Product and/or Services, and maintain company records. We complete an annual company wide data tidy up which may involve deletion of the data outlined in this policy.
The Sites are not intended for users under the age of 18, and we have no intention of collecting personally identifiable information from children (i.e., individuals under the age of 18). If a parent or guardian learns that a child has provided us with personally identifiable information, that child's parent or guardian should send us a request marked "Privacy — Urgent" to privacy@buildsoft.com.au if they would like the information submitted by the child deleted from our database. We will use all reasonable efforts to delete such information from our database.
Our Sites are maintained in the Australia. By using the Sites, you freely and specifically give us your consent to export your personally identifiable information to Australia and to store and use it in Australia as specified in this policy.
When using our Sites, Services and/or Products you consent to collection of your personal identifiable information. We may amend our privacy policy at any time and will post those changes on this page, so you are always aware of what information we collect, how we use it and under what circumstances we may disclose it. However, if we plan to materially change the way in which we use or disclose your personally identifiable information, we will provide you with prior notice and a chance to opt-out of such differing uses.

Please note we may need to retain certain information for you to continue using our products and/or services. If you do wish to have your information deleted you may need to consider not using the Sites or Buildsoft Services.
